MAXEX Privacy Policy

MAXEX, LLC and its affiliates (“MAXEX” or “we”) value your privacy. This Privacy Policy describes the information MAXEX collects about you as a visitor to our website, (our “Website”); how we will use the information provided; and with whom we may share the information.

Companies that participate on MAXEX’s multi-seller, multi-buyer residential loan exchange (the “LoanExchange”) should also refer to the LoanExchange Rules and Regulations and the Seller Guide for further information about privacy obligations.

The information we collect

When you visit our Website, we collect a variety of information about you.  For individuals we collect first and last name, organization, title, email and phone number.  If you are acting on behalf of a participant or prospective participant on the LoanExchange, we also may collect certain information on the organization in relation to its usage of and engagement with MAXEX.  

Like other websites and online services, we also collect basic technical information when you visit our Website, such as IP address, frequency of website and/or landing page interaction (if we are able to connect an individual to their IP address), Email engagement (open, non-open, click, opt-out).

Finally, we may collect certain information through the use of “cookies” (also called “HTTP cookies” or “browser cookies”) and other tracking technologies.  We may use session cookies, persistent cookies, and other tracking technologies to better understand how you interact with our Website, to monitor usage by our users and web traffic routing, and to improve and personalize your experiences with our Website.

How we use information

We use this information to directly market to prospects, indirectly market (by sharing content or other useful information), provide information to existing customers, and better understand how people are interacting with our digital platforms.

How we share information

Where appropriate, MAXEX may share your personal information with selected partners to help us provide you, or the company you work for, products or services, or to fulfill your requests, or with your consent. 

California Consumer Privacy Statement

This California Consumer Privacy Statement supplements the MAXEX, LLC Privacy Policy and applies solely to personal information we collect about California consumers, including our website visitors, job applicants and business partners, both online and offline.

This California Consumer Privacy Statement does not apply to our personnel or information collected, processed, sold, or disclosed pursuant to the Gramm-Leach-Bliley Act and its implementing regulations or the California Financial Information Privacy Act.

This California Consumer Privacy Statement uses certain terms that have the meanings given to them in the California Consumer Privacy Act of 2018 (as amended by the California Privacy Rights Act of 2020) and its implementing regulations (collectively, the “CCPA”).

1.Notice of Collection and Use of Personal Information

We may collect (and may have collected during the 12-month period prior to the Last Updated date of this California Consumer Privacy Statement) the following categories of personal information about you:

  • Identifiers: identifiers such as a real name, alias, postal address, unique personal identifier (such as a device identifier; cookies, beacons, pixel tags, mobile ad identifiers and similar technology; customer number, unique pseudonym, or user alias; telephone number and other forms of persistent or probabilistic identifiers), online identifier, IP address, email address, account name,  driver’s license number, and other similar identifiers
  • Additional Data Subject to Cal. Civ. Code § 1798.80: such as signature, physical characteristics or description, state identification card number,  and education information
  • Protected Classifications: characteristics of protected classifications under California or federal law, such as race, color, national origin, age, sex, gender, gender identity, gender expression, marital status, disability, citizenship status, and military and veteran status
  • Commercial Information: commercial information, including records of products or services purchased, obtained, or considered, and other purchasing or consuming histories or tendencies
  • Online Activity: Internet and other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding your interaction with websites, applications, or advertisements  
  • Sensory Information: audio, electronic, visual, and similar information
  • Employment Information: professional or employment-related information, such as resumé information, occupation details, education details, certifications and professional associations, historical compensation details, previous employment details, emergency contact information, pre-employment screening and background check information, including criminal records information
  • Education Information: education information that is not publicly available personally identifiable information as defined in the Family Educational Rights and Privacy Act (20 U.S.C. Sec. 1232g; 34 C.F.R. Part 99)
  • Inferences: inferences drawn from any of the information identified above to create a profile about you reflecting your preferences, characteristics, predispositions, behavior, and attitudes


We may use (and may have used during the 12-month period prior to the Last Updated date of this California Consumer Privacy Statement) your personal information for the purposes described in our Privacy Policy. In addition, we may collect and use your personal information as further described below:

  • To provide our products and services;
  • To communicate with you, including responding to inquiries and requests;
  • To provide marketing, communications and content that may be of interest to you;
  • To perform data analytics, analyze your interactions and activities with us, and understand your preferences;
  • To prevent and protect against fraud and other unlawful activity, and protect and defend the Company against legal claims and other liabilities;
  • To manage career opportunities with us;
  • To manage our relationships with our current or prospective corporate clients, vendors and other business partner personnel;
  • To operate, evaluate and improve our business, including to perform accounting, auditing, record keeping, and other internal functions, and enhancing and developing new products and services; and
  • For legal and compliance purposes, including to comply with and enforce applicable laws and regulations, industry standards and contractual obligations, as well as our policies and terms and conditions.


We also may use these categories of personal information for the following business purposes specified in the CCPA:

  • Performing services;
  • Providing advertising and marketing services;
  • Auditing related to counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance;
  • Short-term, transient use, including, but not limited to, non-personalized advertising shown as part of your current interaction with us;
  • Helping to ensure security and integrity, including by (i) detecting security incidents that compromise the availability, authenticity, integrity and confidentiality of stored or transmitted personal information, (ii) protecting against malicious, deceptive, fraudulent or illegal activity, and helping to prosecute those responsible for that activity, and (iii) ensuring the physical safety of natural persons;
  • Debugging to identify and repair errors that impair existing intended functionality;
  • Undertaking internal research for technological development and demonstration; and
  • Undertaking activities to verify or maintain the quality or safety of our services or devices and to improve, upgrade, or enhance them.


We do not collect or process sensitive personal information with the purpose of inferring characteristics about consumers.  To the extent we process deidentified information, we will maintain and use the information in deidentified form and will not attempt to reidentify the information unless permitted by applicable law.

2. Retention of Personal Information

We will retain your personal information for the period reasonably necessary to achieve the purposes described in our Privacy Policy and this California Consumer Privacy Statement, or any other notice provided at the time of collection, taking into account applicable statute of limitations periods and records retention requirements under applicable law.

3. Sources of Personal Information

During the 12-month period prior to the Last Updated date of this California Consumer Privacy Statement, we may have obtained personal information about you from the following categories of sources:

  • Directly from you, such as when you provide the information;
  • Your devices, such as when you visit our Website;
  • Family or friends, such as when they provide us with your contact information on an application;
  • Our affiliates;
  • Vendors who provide services on our behalf;
  • Operating systems and platforms;
  • For job applicants, recruiting agencies;
  • For job applicants, your job references;
  • For job applicants, data brokers, such as public databases, credit bureaus, credit reporting service providers and background check services;
  • Business and joint marketing partners;
  • Social networks;
  • Government entities.

We also may disclose personal information about you (1) if we are required or permitted to do so by applicable law, regulation, or legal process (such as a court order or subpoena); (2) to law enforcement authorities and other government officials to comply with a legitimate legal request; (3) when we believe disclosure is necessary to prevent physical harm or financial loss to the Company, our guests, patrons, employees, or the public as required or permitted by law; (4) to establish, exercise, or defend our legal rights; and (5) in connection with an investigation of suspected or actual fraud, illegal activity, security, or technical issues.

In addition, we reserve the right to transfer to relevant third parties the personal information we have about you in the event of a potential or actual sale or transfer of all or a portion of our business or assets (including in the event of a merger, acquisition, joint venture, reorganization, divestiture, dissolution, or liquidation), or other business transaction.

We also may share the information in other ways for which we provide specific notice at the time of collection and obtain your consent to the extent required by applicable law.

5. Sale or Sharing of Personal Information

We do not sell your personal information in exchange for monetary compensation. We may share your personal information with certain third parties (such as advertising partners) or allow them to collect your personal information via automated technologies on our website for cross-context behavioral advertising purposes. This kind of sharing may be considered a “sale” or “sharing” under California when the personal information is exchanged for non-monetary consideration.

We may sell or share for cross-context behavioral advertising purposes (and may have sold or shared during the 12-month period prior to the date this California Consumer Privacy Statement was last updated), the following categories of personal information to online advertising services and social networks: (1) Identifiers; (2) Online Activity; (3) Inferences and (4) Commercial Information. You have the right to opt out of these disclosures of your information, as detailed below. We do not have actual knowledge that we sell or share the personal information of minors under 16 years of age.

6. California Consumer Privacy Rights

You have certain choices regarding your personal information, as described below.

Access: You have the right to request, twice in a 12-month period, that we disclose to you the personal information we have processed about you, and additional details relevant to such processing. 

Correction: You have the right to request that we correct the personal information we maintain about you, if that information is inaccurate.

Deletion: You have the right to request that we delete certain personal information we have collected from you.

Opt-Out of Sale or Sharing: You have the right to opt-out of the sale or sharing of your personal information. To opt out of the sale of your personal information or sharing of your personal information for cross-context behavioral advertising, click here or on the link “Do Not Sell or Share My Personal Information” in the footer of our website, or use the Global Privacy Control signal. Note that if you clear your cookies on a particular browser or device, you may need to re-submit your opt-out request. Verifying Requests: To help protect your privacy and maintain security, we will take steps to verify your identity before granting you access to your personal information or complying with your request. If you request access to or correction or deletion of your personal information, we may require you to provide any of the following information (such as your name, address, phone number, and/or information related to your interactions with us). In addition, if you ask us to provide you with specific pieces of personal information, we may require you to sign a declaration under penalty of perjury that you are the California resident whose personal information is the subject of the request. If you designate an authorized agent to make a request on your behalf, we may require the authorized agent to provide proof that you gave the agent signed permission to submit the request, and we may require you to verify your own identity directly with us.

Additional Information: You have the right to not be retaliated against if you choose to exercise any of your rights under the CCPA.
